General Terms and Conditions of Sale (GTC)

Preamble
These General Terms and Conditions of Sale (hereinafter “GTC”) govern the sale of reproductions of works (hereinafter “the Prints” or “the Products”) created by Lossapardo and sold by Merci Pour La Lumière, SASU, registered under SIRET number 90363978900010, with its principal place of business located at 27 rue de Valmy 77200 Torcy (FR), (hereinafter “the Seller”), on the website lossapardo.com (hereinafter “the Site”).
Any order placed on the Site implies the buyer’s (hereinafter “the Customer”) unconditional acceptance of these Terms and Conditions.

Article 1 — Purpose
The purpose of these Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale of art prints, digital reproductions, or prints of the artist’s original work offered for sale on the Site.
These Terms and Conditions apply to the exclusion of all other terms and conditions, including those applicable to other sales channels.
Article 2 — Products
2.1 Description
Each print is presented on the Website with a description specifying, to the extent possible:
- the title of the original work;
- the format (dimensions);
- the printing technique (e.g., giclée/pigment printing, offset, etc.);
- the substrate (paper, canvas, etc.) and its weight;
- whether or not it is a limited edition and, if so, the edition number and the total number of copies;
- whether or not it includes a signature and/or a certificate of authenticity.
2.2 Nature of the Product
Unless explicitly stated otherwise on the product page, the Prints sold are **reproductions** of the original work and not the original work itself. The Customer acknowledges having been informed of this prior to any purchase.
2.3 Variations
The colors and appearance of the Prints may vary slightly from the images displayed on the Site due to differences in screen calibration. Such variations shall not constitute a lack of conformity.
Article 3 — Prices
Product prices are listed in euros (€), inclusive of all taxes (TTC) [or “excluding taxes, VAT not applicable, Art. 293 B of the CGI” if you are exempt from VAT—to be adapted according to your status].
Shipping costs are displayed before the final confirmation of the order and are added to the price of the Products, unless otherwise stated.
The Seller reserves the right to modify its prices at any time, provided that the price appearing on the order at the time of its confirmation by the Customer shall be the only price applicable to that order.
Article 4 — Order
4.1 Process
The Customer selects the Product(s) they wish to order, adds them to their shopping cart, and then confirms their order by following the steps indicated on the Site (order summary, delivery options, payment).
4.2 Confirmation
Once the order has been confirmed and payment has been made, the Customer will receive a confirmation email summarizing the details of their order.
4.3 Availability
Products are offered while supplies last. In the event of unavailability after an order is placed (particularly for limited editions), the Seller agrees to notify the Customer as soon as possible and to refund the amounts paid without delay.
Article 5 — Payment
Payment is made online at the time of ordering using the methods offered on the Website (credit card, Paypal).
The Seller uses a secure payment service provider; the Customer’s banking information is neither transmitted to nor stored by the Seller.
The order is considered final only upon the Seller’s actual receipt of payment.
Article 6 — Delivery
6.1 Delivery Areas
Products are delivered to the addresses provided by the Customer at the time of ordering, in all geographic areas where the carrier provides service.
6.2 Delivery Times
The delivery times indicated on the Website are provided for informational purposes only and begin upon confirmation of the order. The Seller agrees to hand over the package to the carrier within a maximum of one month. In the event of an exceptional surge in orders, this timeframe may be exceeded, and customers will be notified. If the delay exceeds 30 days, the Customer may cancel their order under the terms set forth in the Consumer Code (Article L216-6).
6.3 Packaging
The prints are carefully packaged to prevent any damage during shipping.
6.4 Inspection upon Receipt
The Customer is required to check the condition of the package upon receipt and to report any issues (damage, open package) to the carrier and to the Seller within 48 hours, accompanied by photos if possible.
Article 7 — Right of Withdrawal
In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer, as a private consumer, has 14 days from receipt of the Product to exercise their right of withdrawal, without having to provide a reason or pay a penalty, except for return shipping costs.
7.1 Exercising the Right
To exercise this right, the Customer must notify the Company of their decision via an unambiguous statement sent by email to agent@lossapardo.com before the 14-day period expires.
7.2 Returning the Product
The Customer then has 14 days to return the Product, in its original condition, to the following address: 27 rue de Valmy 77200 TORCY (FR). The Customer is responsible for return shipping costs.
7.3 Refund
The Seller will refund the Customer the amounts paid (excluding the initial shipping costs) within a maximum of 14 days from receipt of the returned Product, provided that the Product is in perfect condition.
Article 8 — Intellectual Property
8.1 Copyright
The original work, as well as all reproductions, images, texts, logos, and graphic elements on the Site, are protected by copyright and remain the exclusive property of Lossapardo, in accordance with Articles L111-1 et seq. of the Intellectual Property Code.
8.2 Purchase of a Print = Purchase of a Physical Medium, Not a Transfer of Rights
The purchase of a Print grants the Customer only physical ownership of the physical object (the print). It does not grant any rights to reproduce, display, commercially exploit, or distribute the work.
In particular, the Customer shall refrain from:
- reproducing, scanning, or photographing the Print for commercial purposes;
- using the image of the work for commercial, advertising, or promotional purposes without the Seller’s prior written authorization;
- reselling reproductions of the Print.
Any unauthorized use may be subject to legal action for infringement.
Article 9 — Legal Warranties
The Seller remains bound by the following statutory warranties, which apply to all consumers, without the Customer having to make a specific request:
- Statutory warranty of conformity (Articles L217-3 et seq. of the Consumer Code);
- Statutory warranty against latent defects (Articles 1641 et seq. of the Civil Code).
In the event of non-conformity or a proven latent defect, the Customer may request replacement, repair, or a refund for the Product, in accordance with the terms provided by law.
Article 10 — Liability
The Seller shall not be held liable for failure to perform the contract in the event of force majeure, stock shortages, strikes, or any other event beyond its control.
The Seller shall not be held liable for damages resulting from the Customer’s misuse of the Product (prolonged exposure to sunlight, humidity, improper framing, etc.).
Article 11 — Personal Data
The personal data collected during the order process (name, address, email, phone number) is necessary for processing the order and is handled in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

Article 12 — Mediation and Disputes
In the event of a dispute, the Customer is invited to first contact the Seller to seek an amicable resolution via agent@lossapardo.com.
If an amicable resolution cannot be reached, the Customer may use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
Article 13 — Governing Law
These Terms and Conditions are governed by French law. In the event of a dispute, and if an amicable resolution cannot be reached, the French courts shall have exclusive jurisdiction.
Article 14 — Amendments to the Terms and Conditions
The Seller reserves the right to amend these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order.
